RETURN OF GOODS AND RIGHT OF WITHDRAWAL
1. Return Policy: VIVA LA MAMMA is willing, until further notice, to accept goods purchased from them for a full refund under the following conditions: Returns must be made within 14 days from the invoice date, in their original packaging, undamaged, and accompanied by the original invoice. Promotional offers marked as such will be accepted only in the quantity purchased. Returns will be processed at the price valid at the time of the original purchase. The refund will be issued in the form of store credit. Excluded from this policy are special order items, display items, clearance items, discontinued items, and partial quantities from packaging units, partial quantities from sets, and items from auctions.
2. Consumer Rights of Withdrawal: If the buyer is a consumer according to consumer protection laws and has placed their order by mail, phone, fax, email, or through the internet online shop, they can withdraw from the purchase contract within fourteen days from the day the goods are received, as per §§ 11 FAGG, deviating from point 5.1. The withdrawal period starts once the buyer or a third party named by them has received the goods. In the case of a contract for multiple goods, the withdrawal period starts once the buyer or a third party named by them has received the last partial shipment, the last item, or the last piece. Saturdays, Sundays, and holidays are counted in the calculation of the period. To meet the withdrawal deadline, it is sufficient to send the withdrawal notice or return the goods on time.
3. Exercising the Right of Withdrawal: To exercise your right of withdrawal, you must inform VIVA LA MAMMA Gastronomie GmbH, 1010 Wien, Dr.-Karl-Lueger-Platz 5, Email: shop@vivalacasa.at, by means of a clear statement (e.g., a letter sent by post or email) about your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient to send the notice of withdrawal before the withdrawal period expires.
4. Consequences of Withdrawal: If you withdraw from this contract, VIVA LA MAMMA will refund all payments received from you, except for delivery costs (and any additional costs resulting from choosing a different delivery method than the cheapest standard delivery offered by VIVA LA MAMMA), without undue delay and no later than fourteen days from the day VIVA LA MAMMA receives notice of your withdrawal from this contract. VIVA LA MAMMA will use the same payment method used in the original transaction for the refund, unless expressly agreed otherwise with you. In no case will you be charged fees for this refund. VIVA LA MAMMA may withhold the refund until the goods have been received back or you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to VIVA LA MAMMA Gastronomie GmbH, 1010 Wien, Dr.-Karl-Lueger-Platz 5, without undue delay and in any event no later than fourteen days from the day you inform VIVA LA MAMMA of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days expires. You will bear the direct costs and the risk of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

6. Exclusion of Right of Withdrawal: For orders placed by mail, phone, fax, email, or through the internet online shop by consumers within the framework of VIVA LA MAMMA's subscription/pre-sale offer according to point 10.1, there is no right of withdrawal according to point 10.4.
7. Exclusion of Right of Withdrawal for Express Delivery: There is no right of withdrawal for the sale of goods by VIVA LA MAMMA Gastronomie GmbH within the framework of "VIVA LA MAMMA Express Delivery" as per point 8 of the "Express Delivery" terms.
